HAMBURG, NY — In a heart-wrenching incident, Markus R. Genovese, a 52-year-old resident of Angola, was arraigned for causing a fatal collision that claimed the life of an 8-year-old boy. The arraignment took place at Erie County Medical Center before State Supreme Court Justice M. William Boller, acting as a Hamburg Town Court Justice.
Genovese faces a series of serious charges including Vehicular Manslaughter in the First Degree, Leaving the Scene of an Incident Resulting in Death, and Driving While Intoxicated. The tragic event occurred on Saturday, June 8, 2024, at approximately 8:10 p.m. at the intersection of Lake Shore Road (Route 5) and North Creek Road in Hamburg.
According to allegations, Genovese, under the influence of alcohol or drugs and without a valid license, rear-ended an SUV stopped at the intersection. The impact resulted in the fatal injury of an 8-year-old boy sitting in the backseat on the driver’s side. A 4-year-old boy, also in the backseat, was injured and treated at Oishei Children’s Hospital.
Following the collision, Genovese allegedly fled the scene but was apprehended in nearby woods by responding officers and transported to ECMC. Acting Erie County District Attorney Michael J. Keane praised the Town of Hamburg Police Department and their Accident Investigation Unit for their swift and thorough response.
Genovese is currently held without bail and is scheduled for a felony hearing on June 13, 2024. If convicted of the highest charge, he could face up to 15 years in prison. Assistant District Attorney Christopher M. McCarthy is prosecuting the case.
