(WNY News Now) – Buffalo, NY – In a decision delivered today, State Supreme Court Justice Debra Givens found Justin L. Davis, 24, guilty of third-degree assault for attacking a probation officer during an incident last year. Davis, of Buffalo, now faces up to a year in jail following his conviction for the misdemeanor charge. The ruling comes after a three-day non-jury trial held in mid-September.

The assault occurred on February 16, 2023, when Davis, in custody at the Erie County Probation Department office in Buffalo, became combative after a warrant had been issued for his arrest due to a probation violation. According to court documents, Davis resisted as probation officers attempted to escort him out of the building. The altercation escalated in a secure hallway and continued onto Pearl Street, where Davis injured a probation supervisor. The entire incident was recorded on surveillance footage, which was presented as evidence during the trial.

Davis will be sentenced on December 17, 2024, at 9:30 a.m. He remains in custody, as he also faces a separate probation violation charge. The case was handled by Assistant District Attorney Mitchell T. Schoellkopf of the Vehicular Crimes Bureau, along with former ADA Andrew S. Criado.

Acting Erie County District Attorney Michael J. Keane commended the Erie County Probation Department for their swift response and thorough investigation.
