(WNY News Now) – A horrifying kidnapping case involving a 77-year-old victim in the Town of Niagara concludes as the second defendant pleads guilty to felony charges.

LOCKPORT, NY – In a pivotal development, Gregory N. Perry, 32, of the Town of Niagara, pleaded guilty to Kidnapping in the Second Degree on Tuesday in Niagara County Court. The charges stem from a disturbing incident earlier this year in which Perry and co-defendant Ashley N. McMillen held a 77-year-old man against his will, allegedly to fund their drug habit.

Presiding Judge John Ottaviano has agreed to sentence Perry to 15 years in state prison followed by five years of post-release supervision. Perry is scheduled for sentencing on January 21, 2025. His accomplice, McMillen, 36, previously entered a guilty plea to the same charge and was sentenced to 10 years in prison with five years of post-release supervision.

The ordeal came to light when Niagara County Sheriff’s Deputies and Town of Niagara Police responded to a call for help. Forced entry into the victim’s home revealed the elderly man restrained, gagged, and in need of medical assistance.

“The defendants put this man through a horrifying ordeal. He was very fortunate that the Town of Niagara Police and Niagara County Sheriff’s Office responded when they did, and how they did. Police forced their way into the victim’s home when they were alerted that he may be in need of
help. They found him restrained, gagged and in need of medical assistance. The motive was to steal for money to buy drugs. We don’t know what would have happened if the police hadn’t responded as they did. The responding officers from both departments should be commended.” said Niagara County District Attorney Brian D. Seaman.

Seaman praised the officers for their decisive response, commending their bravery in breaking into the residence and aiding the victim.

The case was prosecuted by First Assistant District Attorney Doreen Hoffmann and Assistant District Attorney Liesel Marcantonio.
