(WNY News Now) – A Rochester man is facing multiple charges after allegedly calling 911 to stage a robbery and assaulting a responding officer in an unprovoked attack.
ROCHESTER, N.Y. — A Rochester man, Brandon Volpe, 37, has pleaded not guilty to charges stemming from a violent altercation with police on Tuesday afternoon.
The Rochester Police Department (RPD) responded to a reported robbery at the Delta Sonic car wash on West Ridge Road around 4 p.m. However, upon investigation, officers found no evidence of a robbery at the scene.
During their inquiry, Volpe approached a uniformed officer, asked a question, and then allegedly punched the officer in the face without warning. Police say Volpe continued to strike the officer before being subdued and arrested.
The injured officer was treated at a hospital for facial injuries and later released.
Investigators traced the 911 call reporting the alleged robbery to a phone belonging to Volpe. Authorities believe the false report was part of a deliberate plan to lure officers to the location for the attack.
Volpe now faces charges of second-degree assault and third-degree falsely reporting an incident. He remains in custody at the Monroe County Jail.
Volpe’s next court appearance is scheduled for December 23 at 2 p.m. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
