Devante D. Henley, 32, sentenced for firing shots at vehicle, narrowly missing victim.

(WNY News Now) – BUFFALO, NY — A Buffalo man was sentenced today to 3 ½ years in state prison after attempting to seriously injure a victim in a shooting incident. Devante D. Henley, 32, was sentenced by State Supreme Court Justice Debra Givens, following a guilty plea to attempted assault and criminal possession of a weapon.

The shooting took place on December 8, 2023, at approximately 12:10 a.m. Henley fired multiple shots from an illegal pistol at a vehicle near Ship Canal Parkway and Tifft Street in Buffalo, with the intent to cause serious physical harm to the victim. Though the victim was not injured, the vehicle sustained significant damage, estimated at $13,000.

Henley, who was inside his own vehicle at the time of the shooting, fled the scene immediately after firing the gun. The victim was able to avoid harm, but the shooting caused a traumatic experience and substantial financial loss. Henley later pleaded guilty to one count of Attempted Assault in the First Degree and one count of Criminal Possession of a Weapon in the Second Degree, both Class “C” violent felonies. His guilty plea resolved all charges against him in connection with the indictment.

The investigation, led by the Buffalo Police Department Gun Violence Unit, involved the diligent work of Detective Lon Folts, Detective Robert LaRusch, Det/Sgt. John Losi, and Officer Matt Krug. The DA’s office also praised the support provided by Clarissa Acosta, a victim advocate who worked with the affected party.

Assistant District Attorney Ryan M. Flaherty of the Major Crimes Bureau prosecuted the case.

Henley will serve a determinate sentence of 3 ½ years in prison, followed by 2 ½ years of post-release supervision.
