(WNY News Now) – A 51-year-old Freedom resident was taken into custody following an ATV pursuit and multiple charges stemming from a traffic stop attempt on May 20.

FREEDOM, NY – The Cattaraugus County Sheriff’s Office arrested David L. Smith, 51, of Freedom on May 20, 2025, after he allegedly failed to yield for a traffic stop and led deputies on a brief pursuit while operating an all-terrain vehicle (ATV).

According to the Sheriff’s Office, deputies attempted to initiate a traffic stop when Smith reportedly refused to comply and fled on the ATV. The pursuit ended when the ATV became disabled. Authorities say Smith then attempted to flee the scene on foot but was quickly apprehended.

Smith was transported to the Cattaraugus County Sheriff’s substation in Delevan for processing. He was charged with Resisting Arrest, Unlawful Fleeing a Police Officer in a Motor Vehicle, Obstruction of Governmental Administration in the Second Degree, Aggravated Unlicensed Operation in the Second Degree, along with multiple violations of the Vehicle and Traffic Law.

Following the processing of these charges, Smith was issued appearance tickets to answer the charges in court. He was then turned over to the New York State Police in connection with unrelated outstanding charges. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
