(WNY News Now) – Westfield, NY – A late-night DWI investigation on December 29, 2023, led to the arrest of a 37-year-old man at Crosby’s Mart, Westfield. The incident involved disorderly conduct, resisting arrest, and alleged deception, resulting in a series of charges.
On December 29, 2023, at approximately 9:30 pm, Westfield Police responded to a report of a suspicious situation at 128 E Main Street. Brandon L. Upton, of Westfield, was identified as the subject and subjected to a DWI investigation. It was revealed that Upton allegedly drove under the influence, displaying disorderly behavior at Crosby’s Mart.
Chautauqua County Sheriff’s Office aided in handling the disorderly conduct. During the arrest, Upton purportedly resisted, damaging a Westfield Police patrol car, leading to charges including Criminal Mischief, Resisting Arrest, and Disorderly Conduct. Further investigation discovered Upton’s attempt to use a false alias.
Upton faced charges ranging from DWI to Criminal Impersonation and was arraigned at CAP Court, Chautauqua County Jail.
