(WNY News Now) – New York – New legislation in New York aims to enhance safety measures surrounding e-bikes and lithium-ion batteries, addressing growing concerns over their proper use and potential hazards.

Governor Kathy Hochul has signed a comprehensive legislative package aimed at promoting the safe use of e-bikes and products powered by lithium-ion batteries, while also protecting the safety of New Yorkers. The new laws come in response to the increasing popularity of e-bikes and concerns over incidents involving lithium-ion batteries.

Key provisions of the legislation include:

  1. Quality Standards for Batteries: Legislation S.154-F/A.4938-D prohibits the sale of lithium-ion batteries for micro-mobility devices and mopeds unless they meet specific manufacturing standards. This measure aims to reduce the risk of fires and other hazards associated with substandard batteries.
  2. Safety Resources Development: Legislation S.8743/A.9338 directs state agencies to collaborate in developing and maintaining safety resources related to lithium-ion battery fire prevention. This includes information and protocols for emergency responders.
  3. First Responder Training: Legislation S.8742/A.9337 mandates training materials for first responders dealing with incidents involving lithium-ion batteries, ensuring they are equipped to handle emergencies safely and effectively.
  4. Consumer Education: Legislation S.7503-B/A.1910-B requires retailers to provide operating manuals for micro-mobility devices and bicycles with electric assist, ensuring consumers are informed about safe usage practices.
  5. Accident Reporting: Legislation S.9419/A.7628-A requires reports to be filed following accidents involving e-bikes or e-scooters resulting in injury or death, enhancing transparency and accountability.
  6. Registration Requirements: Legislation S.7703-B/A.8450-B mandates that mopeds be registered at the point of sale by dealers, facilitating better regulation and enforcement of safety laws.
  7. Safety Tagging: Legislation S.7760-A/A.8102-A requires micro-mobility devices to include red tags on charging cords, reminding users to unplug when not in use to prevent overheating and fire risks.
  8. Traffic Law Compliance: Legislation S.7744-D/A.8310-C mandates notices on e-bikes advising users to follow traffic laws and yield to pedestrians, promoting safer streets and responsible riding.

Governor Hochul emphasized the importance of these laws in enhancing public safety and preventing accidents. “As e-bike adoption increases and battery technology continues to develop, I urge New Yorkers to be aware of safety best practices and to use their devices and chargers properly,” Governor Hochul said. “These laws underscore our commitment to help New Yorkers make educated, safe, smart choices with their purchases of products with lithium-ion batteries and how to best store and use them in order prevent any more tragedies from occurring.”

The legislative package follows the “Buy Safe, Charge Safe” campaign launched earlier this year, which aims to educate consumers about the safe handling and use of lithium-ion batteries. With these new laws in effect, New York aims to set a standard for safe micro-mobility device usage and lithium-ion battery management, enhancing both consumer safety and regulatory oversight.
