(WNY News Now) – ROCHESTER, N.Y. — A Rochester businessman has been sentenced to probation and ordered to pay over $800,000 in restitution after admitting to filing a false tax return.

Jeffrey Tome, 62, owner of Tome Enterprises Inc., was sentenced by U.S. District Judge Frank P. Geraci, Jr. to two years of probation, 500 hours of community service, and $805,098.56 in restitution. Tome pleaded guilty to underreporting his business income and failing to pay required payroll and personal income taxes.

According to Assistant U.S. Attorney Richard A. Resnick, Tome operated a gutter repair and installation business in Rochester. Between 2017 and 2021, he cashed 1,679 customer checks worth approximately $1.7 million instead of depositing them into his business account. He then failed to report these funds on corporate tax returns and omitted the associated net profits from his personal tax filings, leading to unpaid personal income taxes totaling $330,137. Additionally, he paid employees $407,573.60 in cash without withholding payroll taxes, resulting in an additional tax shortfall of $62,358.76.

The case was investigated by the Internal Revenue Service, Criminal Investigation Division, under the leadership of Acting Special Agent-in-Charge Henry Chavis.
