Suspect accused of violating order of protection and stealing from vehicle hours later

(WNY News Now) – DUNKIRK, NY – A 33-year-old Dunkirk man is facing multiple charges following two separate incidents involving burglary and theft that occurred on June 30, 2025.

According to the Dunkirk Police Department, officers were called to a business on East 4th Street at approximately 5:46 p.m. for a report of an unwanted subject. The individual, identified as Gabriel M. Soto of Dunkirk, had left the premises before officers arrived. Investigation revealed that Soto was subject to an active order of protection requiring him to stay away from an employee who was working at the time. He had also previously been trespassed from the business.

Soto was later located by police and issued appearance tickets for Burglary in the Third Degree and Criminal Contempt in the Second Degree.

Hours later, at approximately 11:37 p.m., Dunkirk officers responded to a reported disturbance on the 300 block of Swan Street. A resident had confronted a man suspected of stealing items from his vehicle. The suspect fled but was found nearby and again identified as Soto.

Police say Soto was in possession of the vehicle’s keys and several other stolen items. He was taken into custody and issued additional appearance tickets for Petit Larceny, Criminal Possession of Stolen Property in the Fifth Degree, and Unauthorized Use of a Motor Vehicle in the Third Degree.

Soto was released and is scheduled to appear in court at a later date. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
