
ROCHESTER – A Silver Creek man originally charged with violating New York State’s SAFE Act will be appealing his conviction of third-degree criminal possession of a weapon and two counts of third-degree criminal sale of a weapon during a February hearing in NYS Fourth Appellate Court.
Benjamin S. Wassell’s May 2014 conviction in Chautauqua County Court, however, wasn’t from a SAFE Act violation. Wassell originally faced five charges from the New York State Attorney General’s Office, one of which was a SAFE Act violation.
James Ostrowski will represent Wassell, while Matthew B. Keller will represent the State of New York. Oral arguments for the appeal were originally scheduled to be heard this month.
