(WNY News Now) – A Fredonia man was charged with driving while intoxicated after Dunkirk Police stopped his vehicle for erratic driving on the evening of August 31.
According to the Dunkirk Police Department, officers on the 3–11 p.m. shift initiated a traffic stop around 9:01 p.m. on August 31 after observing a vehicle operating erratically while traveling south on Main Street. The vehicle was stopped on Marsden Street, and the driver was identified as 64-year-old Atulkumar K. Patel of Fredonia.
During the stop, police reported that Patel exhibited signs of alcohol impairment. He was asked to exit the vehicle and perform Standardized Field Sobriety Tests, which he allegedly failed. Patel was then taken into custody and transported to Dunkirk Police Headquarters, where he provided a breath sample that registered above the legal limit.
Patel was charged with Driving While Intoxicated (Common Law) under VTL 1192.3 and DWI Per Se under VTL 1192.2. He was issued traffic tickets and released to appear in Dunkirk City Court before Hon. John Kuzdale. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
