Dylan Abbey receives 13-year determinate sentence following multiple drug-related incidents in Jamestown.
(WNY News Now) – MAYVILLE, N.Y. — Jason L. Schmidt announced that Dylan Abbey, 33, of Jamestown, was sentenced February 23 in Chautauqua County Court for convictions stemming from three separate incidents in the City of Jamestown in 2025.
Abbey previously pleaded guilty in November 2025 to two counts of Criminal Possession of a Controlled Substance in the Third Degree and one count of Criminal Possession of a Controlled Substance in the Fourth Degree. The charges related to incidents that occurred on January 27, April 8, and July 20, 2025.
According to the District Attorney’s Office, on January 27, 2025, the Jamestown Police Department attempted to conduct a traffic stop in connection with a search warrant being executed in the city. Abbey allegedly fled in a vehicle, leading officers on a pursuit that ended when his vehicle became stuck in a snow-covered farm field. Police reported recovering several controlled substances from his possession.
On April 8, 2025, officers attempted to take Abbey into custody on an active warrant. During that incident, authorities reported finding him in possession of a large quantity of methamphetamine.
A third incident occurred on July 20, 2025, when police responded to a complaint of an unwanted person. Officers identified the individual as Abbey, who again had active warrants for his arrest. Police said Abbey fled on foot but was later apprehended. Authorities reported that he was found in possession of a large quantity of methamphetamine at that time.
Following his guilty plea, Abbey had been released from the Chautauqua County Jail under supervision by the Chautauqua County Probation Department pending sentencing.
However, on January 27, 2026, Abbey was again arrested by the Jamestown Police Department following the execution of a search warrant in the City of Jamestown. Prosecutors said this arrest violated the terms of his plea agreement, granting the court discretion to impose the maximum sentence on each conviction. Charges related to that January 2026 incident remain pending.
David Foley sentenced Abbey to 10 years determinate in state prison on each of the two third-degree convictions, along with three years of post-release supervision for each count. He was also sentenced to three years determinate in state prison, plus three years of post-release supervision, on the fourth-degree conviction.
The two 10-year sentences will run concurrently. The three-year sentence will run consecutively to the 10-year terms, resulting in a total sentence of 13 years determinate in state prison, followed by three years of post-release supervision.
The District Attorney’s Office credited the efforts of the Jamestown Police Department and the Southern Tier Regional Drug Task Force for their work in the investigation and prosecution of the case.
