(WNY News Now) – Buffalo, NY – Acting Erie County District Attorney Michael J. Keane announced today that a 27-year-old from Buffalo, has been sentenced to 5 years in prison followed by 5 years of post-release supervision after pleading guilty to burglary charges.

In a sentencing delivered by State Supreme Court Justice Paul B. Wojtaszek, Evan T. Thomas of Buffalo received a 5-year prison term along with 5 years of post-release supervision. Thomas, identified as a second felony offender, was sentenced following his guilty plea to Burglary in the Second Degree.

The incident dates back to June 27, 2022, when Thomas unlawfully entered a residence in Buffalo with the intent to commit a crime. Encountered by the victim in the kitchen, Thomas was apprehended wearing the victim’s jacket and carrying a bag containing stolen items. The swift response of Buffalo Police officers led to Thomas’s arrest shortly after the incident.

Having pleaded guilty to Burglary in the Second Degree on March 14, 2024, Thomas opted for a guilty plea on the day scheduled for jury selection in his trial, acknowledging the sole count in the indictment.

As part of the sentencing, a final order of protection has been issued on behalf of the victims, effective until May 2032, ensuring their safety.

Acting DA Keane commended the diligent efforts of Officers John Gravius and Nathaniel Rodriguez from the Buffalo Police Department in handling the investigation. The prosecution was led by Assistant District Attorneys Anthony F. Perna and Mitchell T. Schoellkopf, underscoring the collaborative approach in seeking justice in this case.
