(WNY News Now) – A Jamestown man faces multiple charges, including felony aggravated driving while intoxicated, after allegedly crashing into a parked EMS vehicle while under the influence.
On Friday, December 20, 2024, at approximately 7:56 p.m., officers from the Jamestown Police Department’s Second Platoon were dispatched to the 7-Eleven convenience store at 1011 East 2nd Street following reports of a motor vehicle accident involving property damage.
According to the police, 61-year-old Rafael A. Rodriguez struck an occupied Chautauqua County EMS vehicle while entering the store’s parking lot. Upon arriving at the scene, officers conducted an investigation and determined that Rodriguez was driving while intoxicated.
Rodriguez was transported to the Jamestown Police Department, where he submitted to a chemical breath test. Results indicated a blood alcohol concentration (BAC) over 3 times the legal limit of 0.08%.
He was subsequently charged with the following offenses:
- Felony Aggravated Unlicensed Operation (AUO) in the First Degree
- Aggravated Driving While Intoxicated (BAC above 0.18%)
- Driving While Intoxicated (Per Se)
- Consumption of Alcohol in a Motor Vehicle
Rodriguez is being held pending arraignment in Jamestown City Court. As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
