Erie County District Attorney Michael J. Keane announced the indictment of 28-year-old Denzel T. Maye of Buffalo, charged with one count of Murder in the Second Degree and one count of Criminal Possession of a Weapon in the Second Degree. The charges stem from the fatal shooting of 52-year-old Howard Shelton in the Elmwood Village neighborhood.

The incident occurred on Thursday, October 24, 2024, around 2:00 p.m. near the intersection of Potomac Avenue and Elmwood Avenue. Authorities allege that Maye intentionally shot Shelton with an illegal firearm. Shelton was pronounced dead at the scene.

Maye was arraigned before Erie County Court Judge Sheila A. DiTullio. He was held without bail, and a return court date has not been set.

If convicted of the highest charge, Maye faces a potential sentence of 25 years to life in prison.

District Attorney Keane acknowledged the efforts of Detective Sergeant Keith Fitzner and Detective Mark White of the Buffalo Police Department for their diligent work on the case. The prosecution will be handled by Assistant District Attorney Rebecca L. Schnirel of the Homicide Bureau.

As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
