State Police, Chautauqua County DA Treating June Shooting As Homicide

DUNKIRK – New York State Police and the Chautauqua County District Attorney’s Office are treating a June 11 death as a homicide.

Chautauqua County District Attorney Jason Schmidt tells WNY News Now that the victim is 41-year-old Andrew Garner.

Troopers from the State Police Barracks in Fredonia responded to a welfare check on State Route 5 in the Town of Dunkirk just after 2:30 a.m. Friday.


They say a male subject, later identified as Garner, was found dead at the scene.

“There’s no question this is a homicide,” Schmidt said. The District Attorney, however, did not provide specifics when asked why his office and State Police determined the shooting was a homicide.

The Bureau of Criminal Investigation and state police forensic identification unit are now actively investigating this incident.
