(WNY News Now) – The Chautauqua County District Attorney’s Office has stepped back from prosecuting Sally Jaroszynski over alleged Elections Law violations, appointing the Erie County DA as Special Prosecutor.

Mayville, N.Y. – The Chautauqua County District Attorney’s Office has formally recused itself from the case involving Sally Jaroszynski, who faces allegations of violating Elections Law. In a statement issued on Friday, the DA’s office announced its decision to avoid any potential conflicts of interest by transferring the case to the Erie County District Attorney’s Office, which will assume responsibility as Special Prosecutor.

Jaroszynski, a judge and candidate for Chautauqua County Family Court Judge, stands accused on 2 counts of Misconduct in Relation to Petitions, in violation of Election Law Article 17-122/7.

Article 17-122/7 of New York State Election Law outlines eight violations that can result in such charges, relating primarily to the fraudulent collection of signatures for petitions and political nominations, and can be read in full here.

As are all persons accused of a crime, the accused is presumed innocent until proven guilty in a court of law.
